Aston Fencing Academy – Terms and Conditions

1. Introduction

These Terms and Conditions govern participation in classes, programmes, events, parties and activities operated by Aston Fencing Academy.

By enrolling a child in any Aston Fencing Academy class, programme, event or party, parents or guardians agree to these Terms and Conditions in full.

Aston Fencing Academy operates as a sole trader business.

2. Acceptance of Terms

By booking a class, programme or event, or by allowing a child to attend any Aston Fencing Academy activity, the parent or legal guardian confirms that they:

• Have read and accepted these Terms and Conditions
• Accept the inherent risks associated with sporting activities
• Accept that participation is at their own risk
• Confirm all required information provided is accurate and complete


3. Participation Requirements

Children may not participate in any Aston Fencing Academy session until:

• A waiver / consent form has been completed
• All required personal and medical information has been provided
• Emergency contact details have been submitted

Aston Fencing Academy reserves the right to refuse participation if the required documentation has not been completed.


4. Medical Information

Parents or guardians must declare any:

• medical conditions
• physical injuries
• allergies
• learning needs
• behavioural needs
• medication requirements

Failure to disclose relevant information may result in the child being unable to participate.

Parents remain responsible for ensuring that their child is medically fit to participate in physical activity.


5. Assumption of Risk

Aston Fencing Academy provides structured children’s activity sessions using foam and lightweight plastic equipment.

Activities are designed to be safe, controlled and supervised at all times, however as with any physical activity there is an inherent risk of minor injury.

By enrolling a child, parents acknowledge and accept that participation involves physical activity and carries a level of risk.

While all reasonable precautions are taken, Aston Fencing Academy cannot guarantee that injuries will not occur.

Participation is undertaken at the participant’s own risk.


6. Liability Disclaimer

To the fullest extent permitted by law, Aston Fencing Academy shall not be held liable for:

• any injury sustained during participation in activities
• any injury resulting from misuse of equipment
• any accidental injury occurring during participation in classes, events or parties
• any loss or damage to personal belongings
• incidents occurring at third-party venues
• events beyond our control

Participation in activities is undertaken entirely at the participant’s own risk.

Nothing in these terms excludes liability where it cannot legally be excluded under UK law.


7. Equipment Use

All equipment must be used only as instructed by coaches.

Misuse of equipment may result in removal from the session.

Aston Fencing Academy cannot accept liability for injuries resulting from misuse of equipment.


8. Behaviour Policy

Respectful behaviour is expected from all participants and parents.

The following behaviour will not be tolerated:

• aggressive behaviour
• abusive language
• threatening behaviour
• bullying or harassment
• behaviour that disrupts the safety or enjoyment of others

Aston Fencing Academy reserves the right to remove any participant or parent from activities or venues where behaviour is considered unacceptable.

No refunds will be provided in such circumstances.


9. Safeguarding

Aston Fencing Academy takes safeguarding responsibilities seriously.

We are legally required to report any safeguarding concerns to the appropriate authorities.

Parents and guardians agree that any safeguarding concerns may be reported where required by law.


10. Collection of Children

For safeguarding reasons, children will only be released to an authorised adult.

A unique collection password will be issued for each participant.

Children will not be released without the correct password unless prior written arrangements have been made.


11. Venues

Classes may take place at third-party venues.

Aston Fencing Academy is not responsible for:

• venue facilities
• venue equipment
• venue safety outside of the class activity area

If a venue cancels or becomes unavailable at short notice, Aston Fencing Academy reserves the right to:

• relocate the class to an alternative venue
• change the venue within a reasonable distance


12. Class Schedule Changes

Class times may occasionally need to change due to venue availability or venue requirements.

Aston Fencing Academy has limited control over venue scheduling and reserves the right to adjust class times where necessary.

Reasonable notice will be provided where possible.


13. Coach Availability

If a class must be cancelled due to:

• coach illness
• coach unavailability
• operational circumstances

The cancelled session will be added to the end of the programme block.

Refunds will not be issued for cancelled sessions.


14. Programme Structure

Many courses operate as structured multi-week programmes, typically delivered over 10 coached sessions.

Where sessions are cancelled by Aston Fencing Academy due to coach illness, venue issues, operational circumstances or events outside our reasonable control, the affected session will be rescheduled and added to the end of the programme wherever reasonably possible.

Participant absences do not qualify for refunds, credits or replacement sessions.


15. Force Majeure

Aston Fencing Academy shall not be held liable for cancellations, delays or disruptions caused by circumstances outside our control including but not limited to:

• severe weather
• venue closure
• government restrictions
• illness outbreaks
• accidents
• acts of God
• emergencies

In such cases sessions may be rescheduled where possible.


16. Personal Belongings

Participants bring personal belongings to venues at their own risk.

Aston Fencing Academy accepts no responsibility for:

• lost items
• stolen items
• damaged belongings


17. Photography and Media

Occasionally photographs or videos may be taken during sessions for promotional purposes.

Parents will be informed and may opt out where appropriate.


18. Parties and Events

Some events may include:

• lighting effects
• music
• theatrical effects
• flashing lights

Parents should ensure this is suitable for their child before participation.


19. Refunds and Cancellations

Refund and cancellation policies are detailed in the Refund and Cancellation Policy page, which forms part of these Terms and Conditions.


20. Data Protection

Personal information is collected and processed in accordance with UK data protection laws and used only for the administration of Aston Fencing Academy services.


21. Amendments

Aston Fencing Academy reserves the right to update or modify these Terms and Conditions at any time.

The most recent version will always be published on the website.


22. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.
